Terms & Conditions of Participation in the Oscar Bravo GmbH Giveaway “Oscar Bravo’s Easter Surprise”

1. General
Thank you for your interest and your participation in our “Oscar Bravo’s Easter Surprise” (in the following “prize draw”).
Participation in the prize draw is possible during the days of
Thursday, April 17th, 2025 (11:00 a.m. CET) to Thursday, April 24th, 2025 (11:59 p.m. CET)
In context of the prize draw, the prize will be drawn from among the duly registered participants who have followed the Oscar Bravo company account and added a comment under the giveaway post shared April 17th, 2025. The prize entails a pair of Oscar Bravo branded socks. Three winners will be randomly selected and contacted within 48 hours after the closing of the giveaway. The winners will be contacted via direct message on LinkedIn. In this message, the winner will receive all necessary details regarding prize redemption.
2. Terms & conditions of participation
a. The prize draw is open to all persons aged 18 and over. Participation in the prize draw is only possible via a comment under the Oscar Bravo LinkedIn post announcing the giveaway on April 17th, 2025, and having followed Oscar Bravo on LinkedIn.
b. The recipient of the information provided by all users in connection with the prize draw is Oscar Bravo. The information provided will be used exclusively in connection with the prize draw and for communications in connection with this prize draw and in accordance with Section 7 of the Data Protection Notice (name and address).
c. Employees of Oscar Bravo business are excluded from participation.
d. Participation in the prize draw is free of charge. The chance of winning and participation is independent of the purchase of goods or services. The participant themselves must bear the costs of participation, such as Internet connection or mobile phone.
e. The participant is responsible for the correctness of the contact data provided.
f. By participating in the prize draw, participants accept these conditions of participation and confirm that they have read the data protection information. Each person can participate only once in the prize draw.
g. The winner must respond within 1 week (7 days) of notification of the prize, otherwise the prize will be forfeited.
h. Oscar Bravo is entitled to exclude participants from the prize draw without notice if they do not meet the requirements of these terms & conditions of participation or if they manipulate or attempt to manipulate the prize draw, in particular its participation process, especially by taking part several times, and/or culpably violate the rules of participation.
i. Participation is limited to residents of the European Union.
3. Prize draw prizes and prize draw procedure
3 winners will be randomly selected to win a pair of Oscar Bravo branded socks.
a. The participant in the prize draw will be informed after the prize draw if a prize has been won via a direct message in LinkedIn.
b. Oscar Bravo assumes no liability whatsoever for the delivery of the prizes to the respective winner.
c. In the event that a prize is undeliverable, Oscar Bravo is not obliged to make any enquiries. The winner is solely responsible for providing correct and complete contact details. If the prize cannot be delivered due to incorrect or incomplete information provided by the winner, the winner’s claim to the prize shall be forfeited. In such case, a new winner will be selected by lot.
d. The prize is non-transferable, cannot be exchanged for cash or for vouchers. Partial redemption or splitting of the prize is not possible.
4. Liability
a. Liability of Oscar Bravo, its legal representatives, and vicarious agents for damages is excluded, except in cases of intent or gross negligence. This limitation of liability does not apply to damages resulting from injury to life, body, or health. Furthermore, it does not apply in the event of breach of material contractual obligations (so-called cardinal obligations). In such a case Oscar Bravo’s liability shall be limited in amount and cause to such damages as were typical and foreseeable at the time of conclusion of the contract of use. A material contractual obligation is an obligation the fulfilment of which is essential for the proper fulfillment of the contract and the observance of which the contractual partner may rely on in principle.
b. Oscar Bravo cannot be held liable for any losses or damage arising in connection with participation in the prize draw, the transmission of data or other circumstances, in particular technical difficulties (e.g. overloading), or loss of data. This exclusion of liability does not apply in cases of intent, gross negligence, or injury to life, body, or health.
c. By participating in the prize draw, the participant agrees to indemnify and hold Oscar Bravo harmless from any claims, damages, or losses arising from their participation in the price draw. This does not affect Oscar Bravo’s right to assert claims against the participant in the event of violations of these terms and conditions or applicable law.
5. Premature termination of the prize draw
a. Oscar Bravo reserves the right to cancel or suspend the prize draw at any time without prior notice. This applies in particular if, for technical reasons (e.g. viruses in the computer system, manipulation, or errors in the hardware and/or software), for reasons of manipulation of the participation process, or for legal reasons, due execution of the prize draw cannot be guaranteed.
b. The participant’s claims to performance and compensation in the event of premature termination of the promotion in accordance with Section 6.a. are excluded within the framework of the provision of Section 5.a.
6. Miscellaneous
a. A cash payment, an exchange for other material assets, or a transfer of the prize to another person is not possible. In the unlikely event that the prize is unavailable, Oscar Bravo reserves the right to replace it with a prize of equal or higher value at its own discretion.
b. These terms & conditions of participation may be amended by Oscar Bravo at any time with prior notification if the due execution of the prize draw can no longer otherwise be guaranteed. For the same reason, the prize draw may also be suspended or completely cancelled by Oscar Bravo.
c. Should individual provisions of the terms & conditions of participation be or become invalid, the validity of the remaining terms & conditions of participation shall remain unaffected.
d. These terms & conditions of participation and the legal relationship between the participant and Oscar Bravo are subject exclusively to German law, excluding the UN Convention on Contracts for the International Sale of Goods.
e. The participant waives any legal recourse to contest the decision of the prize draw, except where prohibited by law.
f. This giveaway is not performed in collaboration with LinkedIn.
7. Data protection information
a. As the responsible body within the meaning of the BDSG (new) and the GDPR, Oscar Bravo collects, processes, and uses all personal data provided to Oscar Bravo in the context of this prize draw always in accordance with the applicable data protection regulations. Personal data for the purposes of prize draw procedure will be processed by Oscar Bravo in accordance with Art. 6 (1) p. 1 lit. b) GDPR. Personal data in this sense are the following personal data provided by participants in the context of the prize draw: name and address.
b. Oscar Bravo will not pass on this personal data to third parties. This does not apply to service providers (“data processors”) based in Germany who support Oscar Bravo in the prize draw procedure and who are also obliged to act in accordance with the applicable laws. The collection, processing, and use of your data is solely for the purpose of prize draw procedure. The data provided by the participant will not be stored or used for any other purpose.
c. The personal data of the participant will be deleted after the end of the prize draw, provided that this does not conflict with any statutory retention periods, particularly with regard to compliance with tax regulations.
d. As a participant, you are entitled to the following data subject rights:

- Right to rectification, Art. 16 GDPR
- Right to erasure (“right to be forgotten”), Art. 17 GDPR
- Right to restriction of processing, Art. 18 GDPR

In order to be able to process your application, as well as for identification purposes, we would like to point out that we process your personal data in accordance with Art. 6 Para. 1 lit. c) GDPR and delete it after 3 years.
e. In the event of a request for erasure before the end of the prize draw, this request for erasure will mean the termination of participation in the prize draw if the request for erasure prevents further participation.

1. Allgemein
Wir bedanken uns für Ihr Interesse und Ihre Teilnahme an unserem Gewinnspiel “Oscar Bravo’s Easter Surprise ” (Im Folgenden „Gewinnspiel“).
Teilnahme am Gewinnspiel ist an den Tagen und in den Zeiten von
Donnerstag, 17. April 2025 (11:00 Uhr) bis Donnerstag, 24.Donnerstag, 24. April 2025 (23:59 Uhr) MEZ
möglich.
Im Rahmen des Gewinnspiels wird der Preis unter den ordnungsgemäß registrierten Teilnehmer:innen ausgelost, die der Oscar Bravo LinkedIn Unternehmensseite folgen und unter dem Gewinnspiel Post vom 17.04.2025 einen Kommentar hinterlassen haben. Der Gewinnspiel-Preis umfasst ein gebrandetes Oscar Bravo Sockenpaar. Drei Gewinner:innen werden innerhalb von 48 Stunden nach Ende des Gewinnspiels ausgewählt und über eine Direktnachricht auf LinkedIn benachrichtigt. In dieser Nachricht erhält der/die Gewinner:in alle notwendigen Details zur Einlösung des Preises sowie die allgemeinen Bedingungen im Falle eines Gewinns.
2. Teilnahmebedingungen
a. An der Verlosung können alle Personen ab 18 Jahren teilnehmen. Die Teilnahme an der Verlosung ist nur über das Folgen der Unternehmensseite und einem Kommentar unter dem LinkedIn-Gewinnspiel-Posts möglich, der am 17.04.2025 auf der Oscar Bravo LinkedIn Unternehmensseite geteilt wurde.
b. Empfänger der von allen Nutzern im Zusammenhang mit dem Gewinnspiel angegebenen Daten ist Oscar Bravo. Die zur Verfügung gestellten Daten werden ausschließlich im Zusammenhang mit dem Gewinnspiel und für Mitteilungen im Zusammenhang mit diesem Gewinnspiel und gemäß Abschnitt 7 der Datenschutzhinweise verwendet (Name und Adresse).
c. Mitarbeiter:innen von Oscar Bravo sind von der Teilnahme ausgeschlossen.
d. Die Teilnahme am Gewinnspiel ist unentgeltlich. Die Gewinnchance und die Teilnahme sind unabhängig vom Erwerb von Waren oder Dienstleistungen. Die nutzerseitigen Kosten für die Teilnahme, etwa für Internetverbindung oder Mobilfunk, haben die Teilnehmenden selbst zu tragen.
e. Die Teilnehmenden sind für die Richtigkeit der angegebenen Kontaktdaten selbst verantwortlich.
f. Mit der Teilnahme am Gewinnspiel akzeptieren die Teilnehmenden diese Teilnahmebedingungen und bestätigen die Datenschutzhinweise gelesen zu haben. Jede Person kann nur einmal am Gewinnspiel teilnehmen.
g. Der/Die Gewinner:in muss sich innerhalb von 1 Woche (7 Tagen) nach der Benachrichtigung über den Gewinn melden, andernfalls verfällt der Gewinn.
h. Oscar Bravo ist berechtigt, Teilnehmende ohne Ankündigung von der Teilnahme an dem Gewinnspiel auszuschließen, wenn sie die Voraussetzungen dieser Teilnahmebedingungen nicht erfüllen oder das Gewinnspiel, insbesondere dessen Teilnahmevorgang, manipulieren oder dies versuchen, besonders durch Mehrfachteilnahme, und/oder schuldhaft gegen die Teilnahmeregeln verstoßen.
i. Die Teilnahme ist auf Personen mit Wohnsitz in der Europäischen Union.
3. Gewinnspielpreise und Durchführung des Gewinnspiels
Ausgelost werden drei Gewinner:innen eines Preises von jeweils einem paar gebrandeten Oscar Bravo Socken.
a. Teilnehmende an der Verlosung werden nach der Verlosung über eine Direktnachricht auf LinkedIn benachrichtigt, wenn ein Preis gewonnen wurde.
b. Oscar Bravo übernimmt keinerlei Haftung für die Zustellung der Preise an jeweilige Gewinner:innen.
c. Für den Fall, dass ein Gewinn nicht zustellbar ist, ist Oscar Bravo nicht verpflichtet, Nachforschungen anzustellen. Der Gewinner ist alleine dafür verantwortlich, korrekte und vollständige Kontaktdaten bereitzustellen. Der Anspruch des Gewinners auf den Gewinn verfällt, wenn der Gewinn aufgrund falscher Daten nicht korrekt zugestellt werden kann. Im Falle eines unzustellbaren Gewinns wird ein:e andere:r Gewinner:in ausgelost.
d. Der Gewinn ist nicht übertragbar, kann nicht in Gutscheine umgewandelt werden und ist nicht separat einlösbar.
4. Haftung
a. Schadensersatzansprüche gegen Oscar Bravo sind ausgeschlossen, es sei denn, es liegt Vorsatz oder grobe Fahrlässigkeit vor. Für einen Schaden der Teilnehmenden haften Oscar Bravo sowie ihre jeweiligen gesetzlichen Vertreter:innen und Erfüllungsgehilf:innen nur, soweit der Schaden durch Oscar Bravo, ihre gesetzlichen Vertreter:innen oder Erfüllungsgehilf:innen vorsätzlich oder grob fahrlässig verursacht wurde. Diese Haftungsbegrenzung gilt nicht für Schäden in Form der Verletzung des Lebens, des Körpers oder der Gesundheit. Sie gilt ferner nicht bei der Verletzung vertragswesentlicher Pflichten (sog. Kardinalpflichten). In einem solchem Fall ist die Haftung von Oscar Bravo der Höhe und dem Grunde nach auf solche Schäden beschränkt, die zur Zeit des Abschlusses des Nutzungsvertrages typisch und vorhersehbar waren. Eine wesentliche Vertragspflicht ist die Pflicht, deren Erfüllung die ordnungsgemäße Durchführung dieser Teilnahmebedingungen überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner:innen grundsätzlich vertrauen darf.
b. Oscar Bravo kann in keiner Weise verantwortlich gemacht werden für Verluste oder Schäden, die im Zusammenhang mit dem Gewinnspiel oder einem Übertragungsfehler oder sonstigen, insbesondere technischen Schwierigkeiten (zum Beispiel Überlastung) oder Datenverlusten entstehen.
c. Die Teilnehmenden stellen mit ihrer Teilnahme am Gewinnspiel Oscar Bravo von sämtlichen Ansprüchen, einschließlich Schadensersatzansprüchen, frei, die im Zusammenhang mit der Teilnahme entstehen, sofern keine grobe Fahrlässigkeit oder vorsätzliches Handeln von Oscar Bravo vorliegt. Alle weitergehenden Rechte sowie Schadensersatzansprüche von Oscar Bravo bleiben unberührt.
5. Vorzeitige Beendigung des Gewinnspiels
a. Oscar Bravo behält sich vor, das Gewinnspiel jederzeit, ohne vorherige Ankündigung, abzubrechen oder zu unterbrechen. Dies gilt insbesondere, wenn aus technischen Gründen (z.B. Viren im Computersystem, Manipulation oder Fehler in der Hard- und/oder Software), aus Gründen der Manipulation des Teilnahmevorganges oder aus rechtlichen Gründen eine ordnungsgemäße Durchführung des Gewinnspiels nicht gewährleistet werden kann.
b. Erfüllungs- und Schadensersatzansprüche der Teilnehmenden bei vorzeitiger Beendigung der Aktion nach Ziffer 6.a. sind im Rahmen der Regelung der Ziffer 5.a. ausgeschlossen.
6. Sonstiges
a. Eine Barauszahlung, ein Tausch gegen andere Sachwerte und eine Übertragung des Gewinns auf eine andere Person ist nicht möglich. Für den unwahrscheinlichen Fall der Nichtverfügbarkeit des Gewinns behält sich Oscar Bravo das Recht vor, diesen nach eigenem Ermessen durch einen gleichwertigen oder höherwertigen Preis zu ersetzen.
b. Diese Teilnahmebedingungen können von Oscar Bravo jederzeit mit vorheriger Benachrichtigung geändert werden, wenn ansonsten eine ordnungsgemäße Durchführung des Gewinnspiels nicht mehr gewährleistet werden kann. Aus dem gleichen Grund kann das Gewinnspiel auch von Oscar Bravo unterbrochen oder vollständig abgebrochen werden.
c. Sollten einzelne Bestimmungen der Teilnahmebedingungen ungültig sein oder werden, bleibt die Gültigkeit der übrigen Teilnahmebedingungen davon unberührt.
d. Diese Teilnahmebedingungen und die Rechtsbeziehung zwischen den Teilnehmenden und Oscar Bravo unterliegen ausschließlich deutschem Recht unter Ausschluss des UN-Kaufrechts.
e. Der Rechtsweg ist ausgeschlossen, soweit gesetzlich nicht zwingend etwas anderes bestimmt ist.
f. Dieses Gewinnspiel wird nicht in Zusammenarbeit mit LinkedIn durchgeführt.
7. Datenschutzhinweis
a. Oscar Bravo erhebt, verarbeitet und nutzt als verantwortliche Stelle im Sinne des BDSG (neu) und der DSGVO alle im Rahmen dieses Gewinnspiels an Oscar Bravo mitgeteilten personenbezogenen Daten stets im Einklang mit den anwendbaren datenschutzrechtlichen Bestimmungen. Personenbezogene Daten zur Durchführung des Gewinnspiels werden von Oscar Bravo nach Art. 6 Abs. 1 S. 1 lit. b) DSGVO verarbeitet. Personenbezogene Daten in diesem Sinne sind die folgenden von den Teilnehmenden im Rahmen des Gewinnspiels angegebenen personenbezogenen Daten: Name und Adresse.
b. Oscar Bravo gibt diese personenbezogenen Daten nicht an Dritte weiter. Hiervon ausgenommen sind die Oscar Bravo bei der Durchführung dieses Gewinnspiels unterstützenden, in Deutschland ansässigen Dienstleistungsunternehmen („Auftragsdatenverarbeitende“), die ebenfalls verpflichtet sind, sich entsprechend den geltenden Gesetzen zu verhalten. Die Erhebung, Verarbeitung und Nutzung Ihrer Daten dient ausschließlich dem Zweck der Durchführung des Gewinnspiels. Die von den Teilnehmenden zur Verfügung gestellten Daten werden darüber hinaus nicht gespeichert oder für weitere Zwecke verwendet.
c. Die personenbezogenen Daten der Teilnehmenden werden nach Beendigung des Gewinnspiels gelöscht, sofern dem keine gesetzlichen Aufbewahrungsfristen insbesondere in Hinblick auf die Einhaltung von steuerlichen Regularien, entgegenstehen.
d. Als Teilnehmer:in stehen Ihnen die folgenden Betroffenenrechte zu:
– Recht auf Auskunft, Art. 15 DSGVO
– Recht auf Berichtigung, Art. 16 DSGVO
– Recht auf Löschung („Recht auf Vergessenwerden“), Art. 17 DSGVO
– Recht auf Einschränkung der Verarbeitung, Art. 18 DSGVO
– Recht auf Datenübertragbarkeit, Art. 20 DSGVO
– Widerspruchsrecht nach Art. 21 DSGVO
Zur Wahrnehmung Ihres Rechtes in Bezug auf das obengenannte Gewinnspiel, sowie weiteren Fragen zum Datenschutz im Zusammenhang mit dem Gewinnspiel, können Sie sich per E-Mail an dataprotection@oscarbravo.aero wenden.
Um Ihren Antrag bearbeiten zu können, sowie zu Identifizierungszwecken, weisen wir Sie darauf hin, dass wir Ihre personenbezogenen Daten gemäß Art. 6 Abs. 1 lit. c DSGVO verarbeiten und mit Ablauf von 3 Jahren löschen.
e. Im Falle eines Löschungsbegehrens vor Ende des Gewinnspiels ist mit diesem Löschungsbegehren die Beendigung der Teilnahme an dem Gewinnspiel verbunden, wenn das Löschungsbegehren der weiteren Teilnahme entgegensteht.
